Sometimes it’s possible to file for a Texas uncontested divorce. Our knowledgeable divorce attorneys at the Law Offices of David Kohm can assist with all of your divorce filing needs.   The following information provides a snapshot of the uncontested Texas divorce filing process.    This is not meant to be a step by step process because our experience has taught us that  a majority of divorce cases we work on are unique and don’t always meet the guidelines set forth below.

The Uncontested Divorce Process
At the time you file for divorce in Texas, you as the petitioner or the respondent (your ex) must have resided in Texas for the preceding six (6) month period and be a resident of the county you’re filing in for the preceding ninety (90) day period.
If you’re filing for a No-Fault divorce you must either:

a) provide the grounds as to why you’re ending the marriage. Simply put, you need to document that the marriage is no longer supportable because of personality issues and that there is no reason to believe that the marriage can be reconciled.
b) Indicate on your filing that you and your ex have lived separately for the last (3) and that there has been no cohabitation.

The divorce process in Texas begins when the petitioner has the respondent served with the Original Petition for Divorce along with a Notice of Service. The papers are normally served by the Sherriff, a Constable or process service company.  The Notice tells the respondent he or she has 20 days plus the following Monday to respond to the Petition. The respondent may elect to waive service in writing or decide to not file any answer in which case following the 60 day waiting period, the Court will issue a final decree granting the divorce.
The filing fees for the Original Petition, Citation and Service of Process vary slightly from county to county, but if all three are required can run more than $300.
