Do I need an Attorney for my Injury?
Posted on January 11th, 2016
Ask yourself the following questions to determine if you need an attorney for your injury:
Have you been in an auto accident in which you are not at fault?
If you have been involved in an auto accident where either the driver
of another vehicle, or the driver of a vehicle of which you were a passenger in, was at fault and have sustained an injury as a direct result of this incident, you may need legal assistance to resolve your claim. Personal Injury Attorneys are skilled at obtaining insurance information for liable drivers in auto accidents and in negotiating with insurance companies to resolve injury claims. If you were found at-fault or liable for an accident which caused your injury, it is unlikely that a personal injury can assist you. However, whether or not you were at fault may not always be clear. Furthermore, whether or not you have sustained an injury may not always be apparent. For these reasons, it is best to consult with a personal injury attorney.
Have you fallen or otherwise been injured at a public or privately owned establishment?
Public and privately owned establishments have an obligation to maintain the safety of patrons within their establishment. If the business owners, property owners or management are aware of any potential dangerous situations such as spilled liquids, faulty equipment, or other unsafe conditions, they have the responsibility to remedy the situation and prevent patrons from falling victim to any injuries sustained due to these issues. Often it is very unclear what responsibility the establishment carries as well as whether or not the establishment was negligent in the handling of a potentially unsafe situation. For this reason, after suffering any injury on any property that is not your own, it is advisable to promptly discuss the situation and nature of your injuries with a personal injury attorney to determine if there is liability to the owner of said property.
Have you suffered an injury while a passenger on public transportation or mass transit?
Scenarios where individuals are injured on either public transportation or mass transit systems, the handling of these matters are often further complicated. Typically, these systems are either government owned or are operated by large corporations and the blame can be dodged and/or passed around among the organization long enough to prevent you from recovering any settlement you may be entitled to. Due to the complicated nature of these claims, you should consult with an attorney immediately so that your rights can be protected and evidence can be preserved.
